School Policies

Per board policy 5131.8, students must have all mobile communication devices including, but not limited to smartphones, smartwatches, headphones/earbuds, turned off and kept out of sight during instructional time. Instructional time shall be defined as during the scheduled class period from bell to bell, and any other time during the school day when students are expected to be engaged in a learning activity If these devices interfere with the educational process, the student will receive a referral and the device will be taken to the AP Office. Students will not be given permission to leave class in order to answer a phone call, or text message. The school is not responsible for loss or theft of electronic devices. The unauthorized use of electronic devices is prohibited during class time. *** Students may not record, video, or take a picture of another student or staff without prior written consent.
Students will not have any electronic devices out in the locker room or bathrooms. Any student who takes a photo or video of another student in a bathroom or locker room may be suspended, and may be recommended for expulsion and possible law enforcement charges. Students who post or send inappropriate text messages or photos are subject to disciplinary consequences including suspension or recommendation for expulsion. The incident may be referred to law enforcement. Students who record or post persons, staff or students, without consent will receive Knights Choices, Saturday school, and/or will serve a 1-2 day suspension from the class where the recording occurred.
Consequences: Items will be retained in the AP Office for pickup at the end of the student’s school day.
- 1st Offense – Pick up after school
- 2nd Offense – Parent pick up of device
- 3rd + Offenses – Parent pick up and Saturday School discipline

DRESS CODE
San Marcos High School’s goals for a dress code are to maintain:
- a physically safe learning environment in classes where protective and/or supportive clothing is needed.
- an emotionally safe learning environment free of racist, lewd, vulgar, obscene, threatening, illegal conduct and/or offensive images that may be displayed on attire and contribute to an inappropriate, hostile or intimidating environment.
Our dress code supports equitable educational access and is written in a way that does not reinforce stereotypes. To ensure effective and equitable enforcement of this dress code, teachers and administrators will enforce the code in a way that does not target any group based on race, gender, ethnicity, religion, sexual orientation, household income, gender identity or cultural observance and with the least impact on student learning and self-confidence.
The dress code is as follows:
1. Appropriate shoes must be worn at all times.
2. Undergarments may not be worn as outer garments. See-through clothing and bathing suits are prohibited.
3. All clothing, jewelry, and personal items (including backpacks and binders) shall be free of writing, pictures, or any other insignia which is vulgar, lewd, obscene, profane, or sexually suggestive (no clothing or items with Playboy representations) or which promotes the use of alcohol, drugs, tobacco, or other illegal activities.
4. Clothing may not state, imply, or depict hate speech/imagery targeting groups based on race, ethnicity, gender, sexual orientation, gender identity, religious affiliation, or any other protected classification.
5. As gang-related symbols are constantly changing, definitions of gang-related apparel shall be reviewed at least once each semester and updated whenever related information is received. SMHS collaborates with our School Resource Officer to update definitions of gang-related apparel. Items that are currently prohibited include [Education Code 32282 & 35183]:
Professional sports teams' jerseys and logos on clothing, hats, and accessories (i.e Padres, SD, LA, Raiders, Dodgers, White Sox, etc)
Gang-related writing, symbols, graffiti, or tagging on any property
Monogrammed or lettered belt buckles (e.g., S, N, M, R, B, X, 13, 14)
Bandanas and hair nets
** The spirit of the SMHS dress code is to provide the least restrictive environment possible while assuring maximum community safety. With this in mind,the principal, staff, and parents/guardians at a school may establish a reasonable dress code that prohibits students from wearing gang-related apparel when there is evidence of a gang presence that disrupts or threatens to disrupt the school's activities. When determining specific items of clothing that may be defined as gang apparel, the school shall ensure that the determination is free from bias based on race, ethnicity, national origin, immigration status, or other protected characteristics and will be done in conjunction with law enforcement.
Enforcement (shall be done discreetly, using body-positive language, and without shaming):
Students will be asked to put on their own alternative clothing (if available), or be provided with temporary school clothing, or parents may be called to bring alternative clothing to be worn.
After the first offense, students will not be given the option to change into their own alternative clothing.
In addition, the second offense will result in confiscation of clothing and parent pickup of items.
A parent meeting will result after a third offense. Repeated offenses will lead to progressive discipline consequences such as detention, Knights Choices, and/or Saturday School.
